PerksPro+ Terms of Use

1. Acceptance of Terms

PerksPro+ is a platform provided by Pivot and Prosper Marketing Solutions. By using PerksPro+, you agree to these Terms of Use, as well as any other policies set forth by Pivot and Prosper Marketing Solutions.

2. Platform Responsibilities & Limitations

  • PerksPro+ is a platform provider. We enable businesses to create and manage rewards and loyalty programs but do not oversee their execution.

  • Users are responsible for their own programs. Businesses using PerksPro+ are fully responsible for their promotions, redemptions, customer interactions, and legal compliance.

  • No liability for disputes. PerksPro+ is not responsible for any disputes between businesses and their customers, including reward fulfillment or financial claims.

  • No guarantees. We provide the platform “as is” with no express or implied warranties.

3. Intellectual Property

All content, branding, and design on the PerksPro+ platform (including logos, text, and graphics) is protected under intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without prior written permission.

4. Service Availability & Technical Issues

  • While we strive for 99% uptime, technical issues, third-party service disruptions, or maintenance may occur beyond our control.

  • We will make our best efforts to resolve issues promptly but cannot guarantee uninterrupted access.

  • We are not liable for losses resulting from downtime or service disruptions.

5. Subscription & Cancellation Policy

  • PerksPro+ operates on month-to-month or yearly billing, depending on your selected plan.

  • You must submit a request through our official cancellation form to cancel: https://support-hub.pivotandprospermarketing.com/cancellation-request

  • Your account will remain active until the end of the current billing cycle.

  • No refunds will be provided for unused time.

  • Failure to submit a formal cancellation request may result in continued billing.

Trial Period and Setup Fee

  • PerksPro+ offers a 14-day trial period for new subscriptions. Cancel before the trial ends to avoid being charged.

  • Once the trial ends, the monthly or annual subscription is non-refundable.

  • The $497 setup fee is also non-refundable and covers onboarding, configuration, and training resource access.

6. Account Access and Security

  • You are responsible for keeping your login credentials confidential.

  • You agree not to share your login or impersonate another user.

  • We reserve the right to disable or revoke access to any account if we believe it has been misused.

7. User Conduct & Prohibited Activities

Users agree not to:

  • Use PerksPro+ for fraudulent, illegal, or deceptive purposes

  • Attempt to hack, manipulate, or interfere with the platform’s operation

  • Transmit unsolicited marketing or spam

  • Use bots, scrapers, or automation tools to access the platform

  • Introduce malware, viruses, or malicious code

8. Right to Restrict or Terminate Access

We reserve the right to suspend or permanently disable any account that violates these terms, abuses the platform, or interferes with service for others.

9. Indemnification

You agree to defend, indemnify, and hold harmless PerksPro+, its affiliates, team members, and contractors from any claims, damages, or liabilities arising from your use of the platform or violation of these terms.

10. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages, including but not limited to:

  • Lost profits

  • Data loss

  • Service interruptions

  • Business disruptions

  • Maximum liability is limited to the amount paid to PerksPro+ in the last 30 days before the claim.

11. Governing Law

These Terms are governed by the laws of Hall County, GA. Any disputes shall be resolved under the exclusive jurisdiction of the courts located in Hall County, GA.

12. Changes to These Terms

We may update these Terms of Use at any time. Continued use of PerksPro+ after changes are posted constitutes acceptance of those changes.
