PerksPro+ Terms of Use

1. Acceptance of Terms

PerksPro+ is a platform provided by Pivot and Prosper Marketing Solutions. By using PerksPro+, you agree to these Terms of Use, as well as any other policies set forth by Pivot and Prosper Marketing Solutions.

2. Platform Responsibilities & Limitations

  • PerksPro+ is a platform provider. We enable businesses to create and manage rewards and loyalty programs but do not oversee their execution.

  • Users are responsible for their own programs. Businesses using PerksPro+ are fully responsible for their promotions, redemptions, customer interactions, and legal compliance.

  • No liability for disputes. PerksPro+ is not responsible for any disputes between businesses and their customers, including reward fulfillment or financial claims.

3. Service Availability & Technical Issues

  • While we strive for 99% uptime, technical issues, third-party service disruptions, or maintenance may occur beyond our control.

  • We will make our best efforts to resolve issues promptly but cannot guarantee uninterrupted access.

  • We are not liable for losses resulting from downtime or service disruptions.

4. Subscription & Cancellation Policy

  • PerksPro+ operates on month-to-month or yearly billing, depending on the selected plan.

  • To cancel, you must submit a request through our official cancellation form to ensure proper processing.

  • Your account will remain active until the end of the current billing cycle. No refunds will be provided for unused time.

  • Failure to submit a formal cancellation request may result in continued billing.

  • Trial Period and Setup Fee


    PerksPro+ offers a 14-day trial period for new subscriptions. To avoid being charged, you must cancel before the trial ends. If cancellation occurs after the 14-day period, the monthly subscription fee will be charged for that billing cycle and is non-refundable.

    Please note that the one-time setup fee of $497 is non-refundable, as it covers onboarding, platform configuration, and training resource access.

5. User Conduct & Prohibited Activities

Users agree not to:

  • Use PerksPro+ for fraudulent or deceptive purposes.

  • Violate any laws, regulations, or third-party rights.

  • Attempt to hack, disrupt, or manipulate the platform.

6. Disclaimers & Limitations of Liability

  • No Guarantees: We provide PerksPro+ "as is" with no express or implied warranties.

  • Limited Liability: In no event shall Pivot and Prosper Marketing Solutions (PerksPro+) be liable for any amount greater than the total subscription fees paid by the user in the last 30 days.

  • No Indirect Damages: We are not responsible for any indirect, incidental, or consequential damages, including but not limited to lost profits, lost revenue, business interruption, or loss of data arising from the use of PerksPro+.

7. Changes to These Terms

We may update these Terms of Use at any time. Continued use of PerksPro+ signifies acceptance of the revised terms.
